80TH ANNIVERSARY OF THE ESTABLISHMENT OF THE VIETNAM PEOPLE’S ARMY (PT.2)

Under the Geneva Conference 1954, Vietnam was divided at the 17th Parallel into the Democratic Republic of Vietnam (North) and the Republic of Vietnam (South). As the result of such split, VPA taken the mission to defend the socialist regime in the North and unify the South. In May 1959, the Ho Chi Minh Trail (or Truong Son Trail) was constructed as a centre of the logistic system to supply manpower and weapons to the battlefield. On February 15, 1961, the South Vietnam Liberation Army (Liberation Army), the military force of the National Liberation Front for South Vietnam, was founded on the basis of merging the local armed forces with reinforcements from the North.

From 1963 to 1965, Liberation Army guerrilla won clear victories over Army of the Republic of Vietnam (ARVN) at Ap Bac, Ba Gia and D**g Xoai. After the Gulf of Tonkin Incident, United States increased the number of troops at the South and started the bombing campaign at the North of Vietnam. However, on 31 January 1968, Liberation Army launched the Tet Offensive, inflicted heavy casualties to the US force and ARVN and sent American into shock. The PVA’ successful of the Easter Offensive 1972 (especially Quang Tri Citadel Defence Campaign) and “Dien Bien Phu in the air” led to the signing of Paris Peace Accords, forcing US army to withdraw from Vietnam. Without the support from US army, ARVN quickly collapsed in spring 1975 when the Liberation Army launched the historic Ho Chi Minh Campaign.

In 1977, Khmer Rouge regime of Cambodia attacked the border of Vietnam and killed hundreds of Vietnamese civilians. VPA soon conducted a full-scale counter-attack and eventually removed the Khmer Rouge genocide regime. On the northern border, People's Republic of China started the invasion on February 1979. The fierce resistance from Vietnam border militias resulted in the retreat back of Chinese force one month later.

80TH ANNIVERSARY OF THE ESTABLISHMENT OF THE VIETNAM PEOPLE’S ARMY (PT.1)

Vietnam People’s Army (VPA) was established on 22 December 1944 at Cao Bang Province having the name “Vietnam Propaganda Unit of the Liberation Army” by the directive of Ho Chi Minh to Vo Nguyen Giap. The original strength of the forerunner of VPA was only thirty-four soldiers with very little equipment, captained by Hoang Sam. Just two days following the establishment, the unit achieved their first victories at Phai Khat and Na Ngan against French outposts.

On May 15, 1945, the Vietnam Propaganda Unit of Liberation Army merged with the National Salvation Army and was renamed as the Vietnam Liberation Army (VLA). Exploiting the surrender of Empire of Japan to Allied on 15 August 1945, League for Vietnam Independence (Viet Minh) - with main military force came from Liberation Army - quickly seized the state power. On 2 September 1945, Ho Chi Minh officially declared the independence of Vietnam and the birth of the Democratic Republic of Vietnam (DRV).

On 23 September 1945, French troop returned to Sai Gon. As the consequence of the failure of the diplomatic negotiation between France and DRV, the French Indochina War occurred on 20 December 1946 by the fighting at Ha Noi. In 1950, VLA was renamed to Vietnam People’s Army (VPA). The first decisive victory of the VPA on French Indochina War was the repulse of an assault by French airborne troop at Operation Viet Bac (October – December 1947) followed by the successful attack at French fortified positions along Route 4 on Operation Border Zone three years later (September – October 1950).

The first division of VPA, 308th Division, was created on 28 August 1949. Six more divisions (304, 312, 320, 316, 325 and 351) were raised one after another and five of these divisions (308, 304, 312, 316, 351) participated in the victory of Dien Bien Phu on 1954, “the first time that a non-European colonial independence movement had evolved through all the stages from guerrilla bands to a conventionally organized and equipped army able to defeat a modern Western occupier in pitched battle."(1)

MAIN CONTENTS OF EU-VIETNAM FREE TRADE AGREEMENT (EVFTA)

On 30 June 2019, the EU and Vietnam signed the EU-Vietnam Free Trade Agreement (EVFTA). It is a comprehensive and high-quality agreement that ensures balanced benefits for both Vietnam and the EU, at the same time satisfying principles of the World Trade Organization (WTO). EVFTA went into effect on 1 August 2020.

The agreement consists of 17 chapters, two protocols, and several attached memorandums, with main contents covering the following aspects.

Trade in goods

The EU will eliminate import duties on about 85.6% of tariff lines and this rate would increase to 99.2% after 07 years. In return, Vietnam committed to eliminating tariffs with 48.5% of tariff lines (accounting for 64.5% of import turnover). After 10 years, the tariff elimination rate is about 98.3% of the tariff lines (accounting for 99.8% of import turnover). Vietnam and the EU also agreed on contents related to customs procedures, Sanitary and phytosanitary (SPS), Technical Barriers to Trade (TBT), trade remedies, etc., creating a legal framework for the two sides to cooperate.

Trade in services and investment

The commitment of Vietnam and the EU on trade service and investment is to create a convenient and open investment environment for trade activities from both sides. Vietnam will expand the access of EU service providers in many sectors, including financial services, communication services, transportation services and distribution services. Both sides have agreed on national treatment on investment, as well as discussing a solution for dispute between investors and the government.

Government procurement

Vietnam and the EU agreed with contents similar to the Government Purchase Agreement (GPA) of the WTO with obligations such as online bidding, website portals for bidding information with a roadmap Vietnam has to follow. EU also commits to providing technical support for Vietnam to fulfill these obligations. Vietnam reserves the rights to keep a certain percentage of bid packages for domestic contractors, goods, services and laborers.

Intellectual property

Vietnam will increase the level of protection for EU intellectual property (IP) rights, especially in the area of IP enforcement. The EU pharmaceutical company will benefit from the extension of patent term up to two years.
When the agreement comes into effect, Vietnam will protect 160 EU geographical indications and the EU will protect 39 geographical indications of Vietnam. These Vietnamese geographical indications are related to farm products and food products, such as Moc Chau tea and Buon Ma Thuot coffee.
