Supreme Court orders Senate, House to comment on Petition Challenging Impeachment Voting Threshold

The Supreme Court (SC) has directed the Senate Impeachment Court and the House of Representatives to comment within a period of five days on a petition challenging the ruling that lowered the number of votes required to convict Vice President Sara Duterte today, October 29.

The challenge stems from the September 23 ruling of the impeachment court that only senators who participated in the trial would be counted in determining the denominator of the two-thirds vote required for conviction.

The Petition for Certiorari and Prohibition was filed by Senators Robin Padilla and B**g Go, and the officers of the Partido Demokratiko Pilipino Lakas ng Bayan (PDP-Laban), praying for the Court to stop the Senate Impeachment Court from enforcing its ruling, arguing that its implementation constitutes a “grave abuse of discretion amounting to lack or excess of jurisdiction” and asserting the two-thirds votes must apply to all 24 senators regardless of absences.

The petitioners maintain that the filing is ripe for judicial review and distinct from the earlier dismissed petitions because, as sitting senators, they are directly affected by being forced to participate under a rule they consider unconstitutional.

Originally, three other petitions challenged the ruling but the SC dismissed the petitions on the grounds of prematurity of the issue, given that no final verdict had been laid down.

Veteran Journalist Philip Lustre Seeks Change of Venue in Cyberliber Case

Following his arrest in Quezon City on October 24, veteran journalist Philip Lustre Jr. seeks to transfer his cyberlibel case from Davao City to Metro Manila citing ‘safety concerns.’

The journalist, known for his book “Kill, Kill, Kill” that examined the war on drugs campaign during the Duterte administration, was taken into police custody under a warrant issued by the Davao City Regional Trial Court (RTC) Branch 10.

The arrest was pursuant to a cyberlibel case filed by Manases “Mans” Carpio, husband of Vice President Sara Duterte, based on Lustre’s March 6 Facebook post referencing an alleged Php 300 million payment involving “former bagmen.”

The grant of the petition depends on whether the Supreme Court finds sufficient grounds to warrant a change of venue under Article VIII, Section 5(4) of the 1987 Constitution.

In People v. Datu Andal Ampatuan, Sr. et al., the Court ordered the transfer of criminal proceedings to Quezon City amid concerns that political influence and threats to personal security could prevent witnesses from testifying freely.

Lustre’s defense invokes similar circumstances, citing political influence, partiality, and security risks for request on change of venue. His defense team is yet to file the Petition.

Lustre, who is out on bail, is also set to file motions for reinvestigation and quashal of the complaint.

DPWH Engineer: No Kickbacks for Romualdez

Engr. Carlo Rivera of the Department of Public Works and Highways (DPWH) Bulacan First Engineering District appeared before the Sandiganbayan on October 27, for the bail hearing of former House Speaker Martin Romualdez.

During cross examination, Rivera testified that the former House Speaker was not included in the list of those who received kickbacks from the flood control projects in their engineering district.

In his testimony, however, Rivera testified that he collected kickbacks from various contractors and was remitted to former District Engineer Henry Alcantara.

Rivera also claimed that the collections were eventually delivered to several government officials, including former Ako Bicol Rep. Zaldy Co, former Senator Ramon “B**g” Revilla Jr., former DPWH Undersecretary Roberto Bernardo, and Senator Jinggoy Estrada.

Romualdez is currently detained at the New Quezon City Jail, Payatas for alleged violations of Republic Act 7080 or the Anti-Plunder Law.

SC approves Grassroots Lawyers for Social Change Development

On October 23, 2026, the Supreme Court En Banc officially approved A.M. No. 24-07-24-SC, establishing the Rules on Institutionalizing Support for Development and Social Change Lawyers (DSC Rules).

Promulgated on August 26, 2026, the landmark administrative issuance provides concrete institutional backing, financial support, and legal protections to lawyers and civil society organizations that advocate for the marginalized and underserved communities in the Philippines.

In line with the Strategic Plan for Judicial Innovations 2022-2027 (SPJI), the SC recognized the need to standardise support for full-time lawyers working with grassroots communities such as, but not limited to, alternative lawyers, human rights advocates, public interest attorneys, and developmental legal aid workers.

As traditional alternative law groups relied on short-term, project-based grant funding, full-time lawyers in the sector often face extreme financial instability, forcing them to abandon the practice for private law firms. The DSC Rules aim to establish DSC lawyers as a distinct, recognized, and financially viable full-time career path within the Philippine legal profession by ensuring financial sustainability.

To safeguard and sustain public interest practitioners, SC has introduced different institutional support mechanisms for lawyers and organizations:

-They gain safeguards against strategic lawsuits against public participation (SLAPP);
-They are exempted from filing and docket fees when initiating public interest and human rights suits on behalf of indigent and marginalised sectors;
-They will be given financial support and subsidies to sustain full-time practice
-There will be facilitated reporting and compliance under the SC’s Rules on Unified Legal Aid Service (ULAS);
-Finally, the SC and the Integrated Bar of the Philippines will sponsor training programs to continuously upskill DSC practitioners.

The DSC Rules also extend beyond court representation as they also cover strategic litigation before judicial and quasi-judicial bodies; policy reforms and legislative drafting at both national and local government levels; community legal empowerment, which focuses on rights education and capacity-building so marginalized groups can engage in self-advocacy.

The Rules will officially take effect following publication in the Official Gazette or two newspapers of national circulation, as well as posting on the official websites of the Supreme Court and the Integrated Bar of the Philippines.

DILG sets P50M* bounty for arrest of fugitive Sen. Bato Dela Rosa

In a press conference at the Philippine National Police (PNP) National Headquarters today, October 23, Department of Interior and Local Government (DILG) Secretary Jonvic Remulla announced a *P50 million reward for anyone who can provide information on the whereabouts of Senator Ronald “Bato” dela Rosa.

Remulla said the government had given the senator every courtesy they can afford, but has “showed nothing but cowardice by going to and remaining in hiding.”

“Senator Bato mistook my gesture of negotiation as a sign of weakness. It’s time for the gloves to come off. It’s time to bring justice to the victims,” he added.

Remulla mentioned that a task force has been formed with the sole objective of locating and arresting Dela Rosa.

The Interior Secretary also added that Dela Rosa is considered “armed and dangerous” as authorities intensified the manhunt for the senator, who has been ordered arrested by the International Criminal Court (ICC). The ICC issued the warrant under seal on November 6, 2025, and unsealed it on May 11, 2026.

Dela Rosa was the top cop at the start of former President Rodrigo Duterte’s drug war and is serving his second term as senator.

The arrest warrant cites reasonable grounds to believe he committed the crime against humanity of murder, in incidents in which 32 people were killed between 2016 and 2018.

He was last seen leaving the Senate in the early hours of May 14, 2026.

MARCOS OPPOSES EXPULSION OF CHINESE AMBASSADOR AMID DIPLOMATIC TENSIONS

President Ferdinand Marcos Jr. has no intention, as of October 19, of expelling Chinese Ambassador Jing Quan despite mounting calls from Philippine lawmakers to declare the diplomat persona non grata, Malacañang said.

The calls for expulsion stemmed from Jing’s October 15 remarks suggesting that China could defeat the Philippines if it chose to use force. The ambassador also maintained that China would not resort to force, citing its commitment to peace.

In an ambush interview, Ambassador Jing Quan told reporters, “Now we should feel fortunate enough that you have a neighbor like China in this region. If we want to use force, we may easily win, but no, we will not choose force, and we love peace.”

Marcos subsequently criticized the statement, saying it sounded like a threat and warranted a discussion with the Chinese envoy.

Although the Palace has expressed its opposition to expelling the ambassador, the DFA has reserved the Philippines’ right of taking further diplomatic action if necessary.
