Adamson University College of Law Statement of Support for the EJK Truth Commission.

After nearly a decade since the commencement of the Duterte administration’s brutal war on drugs, justice remains elusive for many of its victims — particularly the poor and the vulnerable — and their families. Compounding this injustice, the accounts of those who endured this campaign have often been discredited or doubted in the face of political idolatry. While the drug menace is undeniably a scourge that “must be curtailed with resoluteness and determination,” jurisprudence is equally clear that “a battle waged against illegal drugs that tramples on the rights of the people is not a war on drugs. It is a war against the people.” (People v. Narvas, G.R. No. 241254, July 8, 2019).

Every community of legal professionals bears the avowed duty to ensure that systemic violations of human rights are never repeated. In this light, the Adamson University College of Law welcomes the formation of the independent EJK Truth Commission and expresses its support for its initiative to establish a definitive and credible record of extrajudicial killings and related human rights violations in the country. As a Vincentian institution of legal learning, we affirm that truth must be heard, safeguarded, and retold, so that similar atrocities are never again committed, especially when committed under the guise of protecting national security. With confidence in the solidarity of our people and trust in the rule of law, we hope these efforts may contribute to a future where “justice will flow like a river and righteousness like an overflowing stream.” (Amos 5:24)

In doing so, we likewise commit ourselves to greater vigilance in upholding truth, justice, and the rule of law in the communities we serve and in the legal profession to which we have dedicated ourselves, in faithful pursuit of our Vincentian mission to serve and stand with the poor and the marginalized.

𝐒𝐓𝐀𝐓𝐄𝐌𝐄𝐍𝐓 𝐎𝐅 𝐓𝐇𝐄 𝐀𝐃𝐀𝐌𝐒𝐎𝐍 𝐔𝐍𝐈𝐕𝐄𝐑𝐒𝐈𝐓𝐘 𝐂𝐎𝐋𝐋𝐄𝐆𝐄 𝐎𝐅 𝐋𝐀𝐖 𝐒𝐓𝐔𝐃𝐄𝐍𝐓 𝐂𝐎𝐔𝐍𝐂𝐈𝐋

As law students, we were taught from the very beginning that the Constitution is not merely a binding set of rules. It is a promise to the Filipino people that no one is above the law, and that public officials must always remain accountable to the nation they serve.

Today, that promise is being tested.

With 𝟐𝟓𝟕 𝐦𝐞𝐦𝐛𝐞𝐫𝐬 𝐨𝐟 𝐭𝐡𝐞 𝐇𝐨𝐮𝐬𝐞 𝐨𝐟 𝐑𝐞𝐩𝐫𝐞𝐬𝐞𝐧𝐭𝐚𝐭𝐢𝐯𝐞𝐬 𝐯𝐨𝐭𝐢𝐧𝐠 𝐢𝐧 𝐟𝐚𝐯𝐨𝐫 𝐨𝐟 𝐭𝐡𝐞 𝐢𝐦𝐩𝐞𝐚𝐜𝐡𝐦𝐞𝐧𝐭 𝐜𝐨𝐦𝐩𝐥𝐚𝐢𝐧𝐭 𝐚𝐠𝐚𝐢𝐧𝐬𝐭 𝐕𝐢𝐜𝐞-𝐏𝐫𝐞𝐬𝐢𝐝𝐞𝐧𝐭 𝐒𝐚𝐫𝐚 𝐃𝐮𝐭𝐞𝐫𝐭𝐞, the Constitution has already spoken through one of its co-equal branches.

Under Article XI, Section 3 of the 1987 Constitution, the duty of the Senate is clear that the impeachment trial must forthwith proceed.

𝙏𝙝𝙞𝙨 𝙞𝙨 𝙣𝙤𝙩 𝙤𝙥𝙩𝙞𝙤𝙣𝙖𝙡. 𝙏𝙝𝙞𝙨 𝙞𝙨 𝙣𝙤𝙩 𝙖 𝙥𝙤𝙡𝙞𝙩𝙞𝙘𝙖𝙡 𝙛𝙖𝙫𝙤𝙧. 𝙏𝙝𝙞𝙨 𝙞𝙨 𝙖 𝙘𝙤𝙣𝙨𝙩𝙞𝙩𝙪𝙩𝙞𝙤𝙣𝙖𝙡 𝙙𝙪𝙩𝙮.

We are deeply alarmed by the continuing attempts to delay and weaken the impeachment process through political maneuvering and alliances clearly meant to protect those in power. At a time when Filipinos are asking for truth, accountability, and honesty from public officials, what we continue to see are efforts to protect political interests instead of uphold the Constitution and serve the people.

𝙒𝙚 𝙡𝙞𝙠𝙚𝙬𝙞𝙨𝙚 𝙘𝙤𝙣𝙙𝙚𝙢𝙣 𝙩𝙝𝙚 𝙜𝙧𝙤𝙬𝙞𝙣𝙜 𝙘𝙪𝙡𝙩𝙪𝙧𝙚 𝙤𝙛 𝙞𝙢𝙥𝙪𝙣𝙞𝙩𝙮 𝙞𝙣 𝙤𝙪𝙧 𝙘𝙤𝙪𝙣𝙩𝙧𝙮.

The law must never depend on power, influence, or political alliances. A justice system that is harsh to ordinary Filipinos but gentle to the powerful is not justice at all.

𝙒𝙚 𝙧𝙚𝙛𝙪𝙨𝙚 𝙩𝙤 𝙖𝙘𝙘𝙚𝙥𝙩 𝙩𝙝𝙞𝙨.

As students of the law and future members of the legal profession, we refuse to remain silent while constitutional processes are ignored and public institutions are used to shield officials from accountability. Silence, especially from those who understand the law, only allows impunity to grow stronger.

𝘽𝙚𝙮𝙤𝙣𝙙 𝙡𝙚𝙜𝙖𝙡 𝙥𝙧𝙞𝙣𝙘𝙞𝙥𝙡𝙚𝙨, 𝙩𝙝𝙞𝙨 𝙞𝙨𝙨𝙪𝙚 𝙞𝙨 𝙙𝙚𝙚𝙥𝙡𝙮 𝙝𝙪𝙢𝙖𝙣.

Behind every call for accountability are Filipino families hoping for honest governance, victims still crying out for justice, and young Filipinos who continue to dream of a country where public office truly means public trust.

We therefore call on the Senate of the Philippines to immediately convene as an Impeachment Court and faithfully perform its constitutional duty. We call on senators to place the Constitution above political alliances and personal loyalties. We call on public officials to remember that their highest duty is not to political dynasties, but to the Filipino people.
