OFFICIAL STATEMENT OF LEGAL COUNSEL:

JAY SONZA SEEKS LEAVE OF COURT TO INCLUDE PRESIDENT MARCOS JR. AS PROPOSED DEFENSE WITNESS: THE CONSTITUTIONAL RIGHT TO PRESENT A DEFENSE MUST BE MEANINGFULLY UPHELD

As legal counsel for veteran broadcaster Jay Sonza, we confirm the filing of a Motion for Leave before the Regional Trial Court of Pasay City, seeking judicial permission to include President Ferdinand R. Marcos Jr. in the list of proposed defense witnesses.

The pending criminal case arises from statements attributed to Mr. Sonza concerning the President’s alleged medical condition and related circumstances.

The defense firmly maintains that the President’s personal knowledge of the matters raised in the Information may be material to a fair and comprehensive determination of the issues before the Court. His proposed testimony is sought to clarify relevant factual circumstances, not to advance speculation or political controversy.

THE RIGHT TO DUE PROCESS IS NOT A MERE PROCEDURAL FORMALITY. IT IS A FUNDAMENTAL CONSTITUTIONAL GUARANTEE.

Under Article III, Section 14 of the Constitution, an accused is entitled to due process and the right to compulsory process to secure the attendance of witnesses and the production of evidence in his behalf, subject to applicable legal requirements.

These guarantees demand a genuine and meaningful opportunity to present a defense, including the identification of witnesses whose testimony may be material to the resolution of the criminal charges.

The defense strongly submits that the proposed testimony deserves careful judicial consideration on its evidentiary merits. The constitutional rights of an accused must be protected through a fair and impartial application of the law, regardless of the public office or position of a proposed witness.

We emphasize that the motion neither presumes the truth or falsity of any allegation nor imputes wrongdoing to the President or any other person. It does not seek the immediate issuance of a subpoena.

The legal team of Mr. Sonza firmly believes that sufficient grounds exist to warrant judicial consideration of the relevance and necessity of the proposed testimony. Its admissibility and the manner by which it may be received remain subject to the determination of the Honorable Court, with full respect for the constitutional prerogatives of the Office of the President.

The defense seeks neither preferential treatment nor extraordinary privilege—only the full and faithful observance of the constitutional guarantees afforded to every accused.

JUSTICE REQUIRES THAT MATERIAL EVIDENCE BE FAIRLY CONSIDERED AND CONSTITUTIONAL RIGHTS BE MEANINGFULLY PROTECTED.
