FREE SPEECH PANEL TUESDAY 2/17

The First Amendment is a cornerstone of American democracy—but today, its protections are being tested in subtler, more complex ways. Join ACS and the SELS for a timely panel examining how free speech is shaped (and constrained) in regulated spaces, universities, immigration enforcement, and other institutional settings.

⚖️ We’ll explore how indirect penalties, private pressures, and shifting norms challenge traditional First Amendment doctrine—and whether existing constitutional frameworks are equipped for what’s next.

🎙️ Panelists:
• Professor Dan Conkle
• Professor Joe Tomain
• Professor Rafael Macía Briedis

🧭 Moderator:
• Professor Jayanth Krishnan

EVENT TOMORROW!!

While the Supreme Court’s ruling in 303 Creative v. Elenis was framed as a victory for free speech, its practical implications signal a dangerous shift in public accommodations law. Join ACS, OUTlaw, and the LGBTQ+ Project for a deep-dive analysis into how the “right to exclude” threatens the civil rights of the q***r community. Our panel of experts will move past the theoretical to discuss the tangible impact on LGBTQ+ expression and the legal precedents now being used to roll back decades of progress in equality.

SPEAKERS:

Jay Kaplan (ACLU of Michigan LGBTQ+ Project attorney) &
Professor Rafael Macía Briedis

SPEAKER EVENT ANNOUNCEMENT 🚨🚨

GOVERNMENT GAGGED: THE FIRST AMENDMENT RIGHTS OF EMPLOYEE WHISTLEBLOWERS

Speaker:🗣️🗣️🗣️
Frank LoMonte is an in-house lawyer at CNN. He formerly ran the Brechner Center at University of Florida and prior to that was the president of the Student Press Law Association.

Topic:
Rules and policies that forbid public employees from speaking about their work are pervasive across all levels of government, from Cabinet-level agencies down to the smallest local school district. While commonplace, these restrictions exist under a dark cloud of constitutional doubt. Decades worth of First Amendment caselaw establishes that public employers cannot gag their employees from sharing information and expertise gathered at work. What rights do public-sector workers have, where do First Amendment freedoms give way to employers’ authority to maintain order, and how is the public affected when government employees are restrained from speaking freely?

Interested in getting involved at Maurer? Becoming a 1L representative is a great way to meet new people and contribute to meaningful causes!

Our mission is to support and advocate for laws and legal systems that redress the founding failures of our Constitution, strengthen our democratic legitimacy, uphold the rule of law, and realize the promise of equality for all, including people of color, women, LGBTQ+ people, people with disabilities, and other historically excluded communities.

If this resonates with you, we encourage you to apply to be a 1L representative for ACS. The 1L reps will be able to observe our executive board this year as they plan and execute future events. This exposure is great expierence for those interested in an executive role next year! Chosen representatives will work together to plan an event on a topic of their chosing.

Don’t worry, we know you are busy and kept the application short!! Just your name, prefered pronouns, IU email address and (in 100+ words) why are you interested in being a board member of ACS. The application is open now and will close at 11:59pm on Tuesday, September 23, 2025. The application can be accessed via the QR code on this post and is also linked in our bio!
