Good News for F-1 International Students!
The court hearing regarding the lawsuit filed by Harvard University/MIT was yesterday. Federal Judge Burroughs stated that the federal government has agreed to rescind the July 6 directive.

“The Department of Homeland Security and U.S. Immigration and Customs Enforcement have agreed to rescind the July 6th policy that would bar international students taking online-only courses from residing in the United States” (Harvard Crimson).

SEVIS/ICE also agreed to return to the original March 9 guidance. The March 9th guidance left “room for schools to comply with state or local health emergency declarations”, which means UK could switch to an online format if it chooses to do so in the fall semester.

This is a huge victory for international students around the globe.

Here’s what this means for you today:
Current students inside the U.S. will not need an updated I-20 or DS-2019 with remarks about their schedule for Fall 2020.
No international students, current or new, outside the U.S. will require an updated I-20 in order to re-enter the U.S.
Current students who plan to be in Lexington in the Fall may continue to enroll in a mixture of online, hybrid, or in-person classes for fall 2020 as planned with a schedule that includes not more than one fully online course.
It is still the case that no international student at UK should have a Fall 2020 schedule that is 100% online.
If, during the fall semester, UK switches to a 100% online format, international students’ immigration status will not be impacted by that switch.
If you have already received a new I-20 in response to the July 6 directive, do not worry. The I-20 remains valid and can be used as proof of F-1 immigration status. We (ISSS) will let you know if any more action is needed. There are some aspects of this decision that have not yet been clarified. As soon as we (ISSS) get clarification from ICE/SEVP we will send another communication.
We are actively seeking information to address several questions, including: 1) Will students be able to maintain F-1 status if they are currently outside of the U.S. and enroll fully in online coursework? 2) Can students apply for OPT while outside of the United States by filing a Form I765, “Application for Employment Authorization,” from abroad?' As this information is clarified, we will send additional communications.

We know that the events of the past week or so have been stressful for you and your families. It is important to understand that the decision to rescind the July 6 directive came about after a massive outpouring of support for international students from U.S. universities and others.

As President Capilouto told the campus: “The presence of international students, faculty and staff is a critical part of who we are, what we value and what we aspire to be as a research university and as an inclusive place, a community that is richer for bringing together people from diverse backgrounds and cultures.”

Since many students have asked me what is going on at UK this fall, I am including a letter from our UK President today.

Dear Campus Community,

Earlier this week, federal officials with the Student and Exchange Visitor Program issued a new regulation that would restrict international students from attending universities that only offer classes online.

We recognize that this announcement has created an air of uncertainty for our international students. I want to emphasize that the University of Kentucky looks forward to welcoming back to campus all of our students — from all backgrounds and cultures — for a residential experience that will provide ample opportunities for face-to-face instruction.

From our initial review of this new policy, we believe we will be able to continue educating and serving our international student community without interruption.

Our plan continues to be to return in August to a robust, residential campus experience. Already, from our initial review of schedules, plans for a majority of classes are focused on in-person instruction. Of course, many students will learn in a mix of ways — in-person classes, online or hybrid approaches.

The regulation, from our initial review, would not appear to interrupt what we do or how we do it. Technology gives us flexibility to meet students and faculty where they are and to shift depending upon their needs at a given moment. We designed this playbook to be flexible and adaptable, given the very fluid environment we find ourselves in today. We will incorporate this policy development, and others as they occur, to ensure that we are safeguarding the health, safety, well-being and education of everyone in our community throughout the academic year.

That said, the regulation as announced this week, understandably, has prompted deep concerns and no small amount of confusion and anxiety in our community.

I want to be clear: a diverse community is a stronger one. It is a better one.

The presence of international students, faculty and staff is a critical part of who we are, what we value and what we aspire to be as a research university and as an inclusive place, a community that is richer for bringing together people from diverse backgrounds and cultures.

I will be joining with a number of my fellow presidents in expressing our concerns to the appropriate federal officials about this policy. I fear it will further create the perception that we are not welcoming and that we do not value the contributions of international students to our community.

At the University of Kentucky, nothing — nothing — could be further from the truth.

Already, our International Center is reaching out to assure international students of our continued support and commitment to them.

Universities are, at their core, about two things: People and ideas.

We are better when we don’t erect barriers to either one.

Thank you for being a place that values the contributions that those from all walks of life, perspectives and backgrounds bring to the mosaic of ideas and people that make us the University of Kentucky.

It is a bittersweet feeling to say that after almost 39 years teaching ESL at UK (I came in the Fall of 1981) that I will be retiring at the end of June. I have had a very rewarding career, and will greatly miss my wonderful students from all over the world. You are amazing people, and getting to know you has been a great honor in my life. Likewise, I am so appreciative of all my volunteers and others who have done so much to enrich students’ lives. I have so many memories and you have given so many blessings.
As you all know, I have done this page for the Center for ESL at UKY.

Scholarship Opportunities
International Student Tuition Scholarship - Apply by June 1
Scholarships will be awarded to continuing F-1 or J-1 undergraduate and graduate students based on minimum academic criteria and financial need. Selection of awards will be made based on the applicant’s ranking within the competitive pool. Tuition scholarships ranging from $500 – $3,000 will be awarded for the next academic year. This tuition scholarship is a one-year, non-renewable award, contingent upon full-time enrollment on the University of Kentucky Lexington campus and a cumulative grade point average of 2.50 or better for undergraduate students and a 3.0 or better for graduate students.

Eligibility Requirements
Applicants must be:
International students in F-1 or J-1 visa status
Current students with a cumulative GPA of 2.50 for undergraduate or 3.0 for graduate and professional students
Demonstrate evidence of financial need
