THE WALL OF SEPARATION AND THE COUNTERWEIGHT OF POWER: THE ECCLESIASTICAL ABSTENTION DOCTRINE IN COMPARATIVE CONSTITUTIONAL PHILOSOPHY

This study offers a comprehensive comparative analysis of the Ecclesiastical Abstention Doctrine within United States constitutional jurisprudence and evaluates its mechanisms against the state-religion paradigms of various global powers, including the United Kingdom, France, Germany, Russia, Japan, and China. From a philosophical perspective, this paper examines how the American doctrine operates not merely as a rule of civil procedure, but as a profound epistemic self-limitation of secular judicial authority, rooted in the political philosophy of absolute state-skepticism. By erecting an impassable jurisdictional barrier under the First Amendment, the doctrine prevents the secular state from engaging in spiritual adjudication, thereby preserving the autonomy of the conscience. In contrasting this model with foreign structural frameworks—ranging from state-church, state- religion synthesis and strict aggressive secularism to total authoritarian subordinations—this paper illuminates the unique socio-legal trade-offs inherent in the American balance of power. Ultimately, it draws theoretical insights for the structural protection of pluralistic spiritual autonomy within modern rule-of-law frameworks.

MEW: As Western science delves into the ultimate nature of matter, it begins to encounter the barrier of consciousness—a realm that Eastern monks have deeply understood for millennia through the inward path of the mind—consciousness.

The fragmentation of knowledge (over-specialization). Modern science is excessively compartmentalized, quantum physicists focus on the world of particles, neuroscientists on neurons, and biologists on cells. Few possess the holistic vision required to interconnect these disciplines.

The trap of objective materialism. Science relies on external instruments for measurement, yet consciousness and life energy are matters of subjective, first-person experience. Attempting to measure consciousness with machines is akin to using a ruler to measure weight; the wrong tool inevitably leads to an impasse.

To the average person, "mathematics" and "meditation" appear worlds apart. However, a brain that has achieved a state of "Global Coherence" through deep meditation perceives them merely as different labels for the same reality. Quantum wave functions, neural electrical fields, and bio-energy flows are, in essence, one and the same. In the absence of distinction, the brain experiences no cognitive friction; data integrates seamlessly, free from fatigue or conflict.

During deep meditative absorption, the brain emits high-amplitude, synchronized Gamma waves. This state functions like a powerful data-compression algorithm, clearing away "noise"—such as mental clutter and survival-based anxieties—and organizing information into a state of absolute order (negentropy).
